Terms & Conditions for Cinema Date Applicants

We invite you to apply to be an “applicant” of the programme and podcast Cinema Date which is a Sky  UK (“Sky”) commissioned and owned production and is being produced by Listen Entertainment Ltd (“Listen”’/”we”). Although we can’t promise you will be selected for the podcast of Cinema Date (“the Podcast”) and/or any other materials Listen Entertainment is producing for Sky UK in respect of Cinema Date, we will read through all applications and give each candidate proper consideration.

To manage the applications and ensure we understand who is applying, here are a few simple rules which we will apply to the structure of the application which you will submit to become a single contestant on the Cinema Date show  and where selected to be a participant in Cinema Date, to any and all further contributions you then make to Cinema Date including and not limited to the Podcast (together “User Contribution”).

These terms and conditions (“Terms”) will become binding on you from the moment your application is submitted to Cinema Date If you do not agree with the Terms, please do not submit your application.

By submitting an application, you grant to Listen and Sky an unrestricted, unlimited and irrevocable right (but not the obligation) to host, use, reproduce, publish, broadcast, display, store, cache, publicly perform, translate, edit, adapt, redact, excerpt and distribute any audio and content you submit as well as any and all other content (audio and/or audio-visual) you subsequently provide in furtherance to your User Contribution in any and all media formats and channels whatsoever and/or howsoever arising and throughout the world, subject to the User Contribution being selected for publication in relation to  Cinema Date.

Any User Contributions not selected for publication and inclusion within the Podcast for Cinema Date and associated materials  will be subject to our deletion policy below.

If the applicant is selected,  the User Contribution may be spoken, quoted or played back and/or otherwise included as an audio clip on the Podcast and will also be listened to by our staff and other third parties involved with the Podcast. As such, any User Contribution uploaded by you should be considered non-confidential and, by posting an application, you agree that we may make use of your User Contribution in any manner connected with the Podcast as we see fit.

Subject to Listen’s acceptance of your application and in consideration of the opportunity to  provide the User Contribution and participate in Cinema Date, you hereby irrevocably and unconditionally assign to Listen and Sky with full title guarantee (and by way of present assignment of present and future rights) and free from all encumbrances, charges, options, licences or other rights of third parties, all copyright and any and all other intellectual property rights in the User Contribution throughout the world for the full period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.

You give permission to Listen, Sky and its licensees and assigns to use the User Contribution in perpetuity and waive any and all moral rights arising in respect of the User Contribution and any and all adaptations and modifications thereto.

You agree that the User Contribution and/or any parts thereof may be broadcast and/or distributed to audiences by any and all media now known or yet to be devised in perpetuity throughout the world.

You understand and acknowledge that Cinema Date and the Podcast is being produced for entertainment and comic purposes and that it will include commentary from the host on User Contributions which may (at times) be provocative, cutting and may be fairly characterised as being ‘less than kind’.  If selected you are agreeing to the inclusion of your User Contribution on said basis.

You further understand and acknowledge that Listen does not conduct criminal background screenings of applicants and participants in this Podcast.  Listen cannot be held liable for false declarations by an applicant or for actions of any nature committed by any applicant who is then selected as a participant in Cinema Date.

In order to preserve anonymity and the security of your personal information, we ask that only first names (or pseudonyms) should be used when recording any audio. We reserve the right to use the names used in each application and, if provided, city or regional locations of the individual(s) concerned.

Users under 18 years of age are strictly prohibited from applying. Aside from this, we welcome and encourage applications from adults of all ages.

We undertake to delete all applications which are not used in the Podcast within sixty (60) days following the decision not to use them.

In applying to be an applicant on Cinema Date you warrant the following:

Your application does not violate the rights of any other person (including without limitation copyright or moral rights, or where the User Contribution amounts to breach a confidence);

Your application is not false, inaccurate, or misleading and you warrant that:

• You are over 18 years of age; and
• You have never been convicted of a violent or sexually related criminal offence.

Your application is on behalf of yourself, or someone who has granted permission to have the application submitted.

You will provide accurate details for personal details including current location, relationship status, and age.

Your application will provide an audio sample of the candidate applying and will explain details about themselves (details in the application process).

Your application is not obscene, lewd, lascivious, violent, harassing, libellous, slanderous, or otherwise objectionable (as determined by us),

Your application intention should not be designed to promote any product or service.

Your application does not violate any applicable law, regulation, or rule, or amount to a contempt of court.

You agree to hold the host, Sky and Listen free and harmless from any liability that arises in relation to your breach of any of the warranties above.

You are not entitled to payment or any other form of compensation for your User Contribution.

You acknowledge and agree that Listen Entertainment and its licensees and assigns (including and not limited to Sky UK) may use any Personal Data (as defined under UK data protection legislation and regulatory requirements in force from time to time including Privacy and Electronic Communications Regulations 2003 (PECR), the European General Protection Regulation (GDPR) and the Data Protection Act 2018 (DPA) (together “UK Data Protection Legislation”)).  All Personal Data provided by you will be processed in accordance with UK Data Protection Legislation and for the purpose of administering this Agreement and in furtherance to your application and (as applicable) incorporation of User Contribution within the Podcast and you provide your consent to this.
